Agile Clarity is committed to respecting the confidentiality of your personal data and your privacy, traffic data and communications content.
This Privacy Policy is designed to assist you in understanding how Agile Clarity uses and safeguards the information you provide in using Agile Clarity's internet communications, Agile Clarity's websites and Agile Clarity’s products.
Information Agile Clarity Collects and Uses
Agile Clarity may gather and use information about you, including (but not limited to) information in the following categories:
- Identification data (e.g. name, username, email address, telephone number, mobile number);
- Employer information (as described in 'Your Sales Sync Company Profile' e.g. name of company, country, logo file(s), address, and other information that you or another user choose to make available to others as part of your Sales Sync company profile
- Employee information (e.g. as shown in 'Your Sales Sync User Profile' but as an employee of the company in your company profile)
- Electronic identification data (e.g. IP addresses, cookies);
- Information about your usage of and interaction with Agile Clarity software, products, websites and communications (including computer, platform, connection and device information, error reports, device capability, bandwidth, page views statistics, traffic to and from our website(s), browser type);
- Logo image file(s) you or other users have chosen to upload for your company;
- List of relevant employees and related data;
- List of your relevant customers/potential customers and related data - where you have provided this to us, or it has been provided by another user at your company and you have accepted the invitation to use Sales Sync as displayed (Agile Clarity does not use it for any other purpose);
- Your Microsoft account - where you have provided this to us, or it has been provided by another user at your company and you have accepted the invitation to use Sales Sync as displayed (Agile Clarity does not use it for any other purpose);
- Any correspondence between you and Agile Clarity;
- Content of instant messaging communications;
- Location information, derived from your mobile carrier, GPS device, or from the mobile device that you use;
- Location information, device identifiers and standard identifiers of the Wi-Fi networks your device detects, when you search for or connect to a WiFi hotspot;
- Authentication tokens for other accounts you associate with your Sales Sync account (such as Microsoft account), which are like an electronic key provided by the service that acts in place of a password for authentication.
How Agile Clarity Uses This Information
Our primary purpose in collecting information is to provide you with an efficient experience, Agile Clarity collects and uses, or has third party service providers acting on Agile Clarity's behalf collecting and using, personal data relating to you, as permitted or necessary to:
- verify your identity;
- provide customer support and troubleshoot problems and errors;
- compare information for accuracy;
- provide internet communication, to convey the communications and files you and others make by means of the Agile Clarity software and/or the Sales Sync products;
- change and customize Sales Sync features and functionality;
- inform you about any service faults, updates and downtime;
- request feedback and comments;
- measure, customise, and improve Agile Clarity software and websites;
- protect your and Agile Clarity's interests.
Disclosure Of Your Information
Except as provided below, Agile Clarity will not sell, rent, trade or otherwise transfer any personal and/or traffic data or communications content outside of Agile Clarity and its controlled subsidiaries and affiliates without your explicit permission, unless it is obliged to do so under applicable laws or by order of the competent authorities. Please note that information that you voluntarily make public in your user profile, and your company profile, or which you disclose on forums, discussions boards or by posting comments will be publicly available and viewable by others.
We may access, disclose and preserve personal data, including your private content (such as the content of your instant messages, stored instant messages, or file transfers), when we have a good faith belief that doing so is necessary to: comply with applicable law or respond to valid legal process from competent authorities, including from law enforcement or other government agencies; protect our customers, for example to prevent spam or attempts to defraud our users, or to help prevent the loss of life or serious injury of anyone; operate and maintain the security of our websites, products and services, including to prevent or stop an attack on our networks or computer systems; or protect our rights or property including enforcing the terms governing the use of our websites, products or services – however, if we receive information indicating that someone is using our products to traffic in stolen intellectual or physical property of Agile Clarity, we will not inspect a customer’s private communications or documents ourselves, but we may refer the matter to law enforcement.
In order to provide you with the Agile Clarity products you have requested, Agile Clarity may sometimes, if necessary, share your personal and traffic data with Agile Clarity’s group companies, carriers, partner service providers and/or agents. For example distributors of and/or the third party organisations for email delivery, analytical services, customer support, or hosting services. Agile Clarity will always require these third parties to take appropriate organisational and technical measures to protect your personal data and traffic data and to observe the relevant legislation.
Some Agile Clarity products may be (i) co-branded; (ii) made available via a partner company's website; and/or (iii) supported through a partner company.
If you register for or use such products, you consent to both NAMES’s and the partner company’s use of personal data collected in connection with the product and you understand that the partner company’s use of your personal data may be subject to the partner company’s privacy policy.
Agile Clarity may offer its products in connection with other websites or services or may team with other online services to give you the combined results of both products/services or additional services and benefits.
To determine whether you would benefit from the combined offer, if you have provided your consent, Agile Clarity may match your email address, and email addresses of your contacts against email addresses you have provided to the third party website/service provider.
If you accept an invitation to use Sales Sync as an Employee of a company registered by someone else, detailed information about the activity on your Sales Sync account including traffic data, details of your instant messages, uploads and downloads, file transfers, system activity and system usage may be accessed by other users of Sales Sync related to your company profile.
If you provide, or accept an invitation to use Sales Sync with specific personal data including (but not limited to) your name, employer name, and job title you acknowledge that such data may be viewed by other members of your company as registered users of Sales Sync.
Agile Clarity, or the operator or company facilitating your communication may provide personal data, communications content and/or traffic data to an appropriate judicial, law enforcement or government authority lawfully requesting such information. Agile Clarity may provide reasonable assistance and information to fulfil such request and you hereby consent to such disclosure.
Information that is collected by or sent to Agile Clarity may be stored and processed in the United Kingdom or any other country (inside or outside of the EU) in which Agile Clarity or its affiliates, subsidiaries, or service providers maintain facilities.
In this regard, or for purposes of sharing or disclosing data in accordance with this article Agile Clarity reserves the right to transfer information outside of your country.
By using Agile Clarity software, Agile Clarity's websites or Agile Clarity products you consent to any such transfer of information outside of your country.
As Agile Clarity continues to develop its business, Agile Clarity might sell or buy subsidiaries or business units. In any such transactions in which Agile Clarity or substantially all of its assets are acquired by a third party, personal information of Sales Sync users will generally be one of the transferred business assets. We reserve the right to include your personal information, company information and employee information in any such transfer to a third party.
In the event of a designated authority lawfully requesting Agile Clarity to retain and/or provide personal data, communications content and/or traffic data, Agile Clarity will provide all reasonable assistance and information to fulfil such a request.

Your Sales Sync User Profile
Your user profile is the information provided by you at registration, or that which is provided by another user in the form of an invitation, which you then accept as correct and accept to use Sales Sync under said profile, or later which is displayed in the Sales Sync software client or on Sales Sync website(s).
It may include your Microsoft account username, first and last name, employer, job title, address, email address, telephone and mobile numbers, country, and any other information that you decide to make available.
Your Sales Sync Company Profile
Your company profile is the information relating to your employer/company provided by you at registration, or that which is provided by another user and which you accepted as correct in the form of an invitation to use Sales Sync under said user and company profile, or later which is displayed in the Sales Sync software client or on Sales Sync website(s).
It may include the company name, an associated logo file and any other information that you decide to make available.
User Invitations
Another User of Sales Sync may (with your consent) enter your personal information such as email address, full names and Sales Sync system security role (similar to a job title), and relate this information to a comapny profile they create.
In such a case you would be presented with this information in the form of an invitation to use Sales Sync as the user / person described in the invitation.
Sales Sync will attempt to identify the person who has entered this information in the invitation.
Your Customer Data
Your customer data is the information relating to your employer's/companies' customers/potential customers which you or another user provide during registration of your employer/company, or which is later provided or displayed in the Sales Sync software client or on Sales Sync website(s)
It may include the company name, address, postcode, telephone number, email address, contact name, geolocation coordinates, any other information that you or another employee at your employer/company decide to make available.
Microsoft Account
Microsoft account (formerly known as Windows Live ID and Microsoft Passport) is a service that allows you to sign into Microsoft products, web sites and services, as well as those of select Microsoft partners.
If you have a Sales Sync account, it is connected to your Microsoft account, in order to use Sales Sync.
To use the Sales Sync app on a Windows 8 or Windows 8.1 device, you must first sign into Windows with a Microsoft account.

Personal Data Of Other Employees
You may be wish to invite other employees at your company to user Sales Sync.
In the event you wish to use this invitation service, you will have the possibility of adding one or more email address, full names and Sales Sync system security role (similar to a job title) in an online form.
The information entered in this form, will only be used for the purposes of generating an invitation message to these potential Sales Sync users
By entering these details you are confirming that these persons have consented to the supply and use of their details.
Sales Sync may identify you as the person who has entered this information in the invitation sent to your friend and may include your name, email address and/or other information in such invitation.
Linked Websites, Third Party Apps, Applications and Websites
Sales Sync and/or Agile Clarity apps, applications and website(s) may contain links that will let you leave Sales Sync's and/or Agile Clarity's products and access another system.
Such linked websites are not under the control of Agile Clarity and these websites have different privacy policies.
This Privacy Policy applies solely to personal information that is acquired on Agile Clarity's apps applications and websites.
Agile Clarity accepts no responsibility or liability for these other websites.
Plug-ins Extras and Third Party Applications
If you use plug-ins, extras, extensions or third party applications together with the Sales Sync software - the providers of such Applications might obtain access to certain personal information about you.
Agile Clarity does not and cannot control how the provider of any such software may use any personal information connected in connection with such Applications.
Mapping Features and Location Data
You can control the ability of the Sales Sync app to access location information in the "charms" > "settings" > "permissions" section or you can refer to the documentation that came with your device for information about how to turn off location features.
If you agree to allow access to your location, Sales Sync can use that information to personalize your experience or provide services you request. Location information may include data available Wi-Fi hotspot data, cell tower data, and Global Position System (GPS) data.
When you use a Sales Sync feature to plot your location using another application or website (such as Google Maps) your longitude and latitude will be passed to the provider of such application or website
Agile Clarity does not and cannot control how the provider of any such software may use any personal information connected in connection with such Applications.

When you use a location based service or feature, available Wi-Fi hotspot data, cell tower data, and Global Position System (GPS) data may be sent to Sales Sync.
Agile Clarity uses location information to provide the services you request, personalize your experience and improve Agile Clarity products and services.
When using the Sales Sync app such location based features are optional.
Protecting Your Personal Information
Agile Clarity will take appropriate technical and organisational measures to protect any personal and traffic data provided to Agile Clarity or collected by Agile Clarity with due observance of the applicable obligations and exceptions under the relevant legislation.
Your personal and traffic data can only be accessed by authorised employees of Agile Clarity or its affiliates, subsidiaries or service providers who may need such access in order to be able to fulfill their given duties.
Ammending Or Accessing Your Personal Data
You have the right to access and, where relevant amend your personal information and data.
We will respond to requests to correct, view, review, complete or remove your personal information within a reasonable period of time and upon verification of your identity.
Agile Clarity will endeavour to use all reasonable means to accommodate any such requests to delete personal information unless it is required to be retained by law or for lawful business purposes.
Contacting You
Agile Clarity reserves the right to use email, telephone numbers you have provided or which are publicly available, or the Sales Sync software itself to notify you about faults, service issues, or any claims related to your use of Agile Clarity software and services, including without limitation claims of violation of third party rights.
Agile Clarity may send you alerts within or through the software, or by email to notify you when someone has tried to contact you.
Agile Clarity may also use Sales Sync software, or email to keep you up to date with news about the Sales Sync software and products and/or to inform you about other Agile Clarity products.
Modifications To This Policy
Agile Clarity will occasionally update this policy when we make such changes we will update the "last revised" date at the bottom of this Privacy Policy.
You agree that your continued use of the Sales Sync software and/or Agile Clarity products after shall constitute your acceptance of the current revision of the Privacy Policy.
We may not be able to contact you to provide notice of such revisions at the time.
Therefore we encourage you to periodically review this Privacy Policy to be informed of how Sales Sync is collecting, using, and protecting your information.
